Abstract

Ushbu maqolada O‘zbekiston Respublikasi jinoyat-protsessual qonunchiligida yangi joriy etilayotgan tergov sudyasi instituti tahlil qilinadi. Muallif ushbu institutni uning klassik namunasi hisoblangan Fransiya tajribasi (Juge d'instruction) bilan qiyosiy o‘rganadi. Maqolada O‘zbekistondagi “nazoratchi” model va Fransiyadagi “faol tergovchi” modelining o‘ziga xos jihatlari, farqlari va afzalliklari yoritilgan. Shuningdek, milliy qonunchilikda inson huquqlari himoyasini kuchaytirish, prokurorning protsessual rolini maqbullashtirish va advokatning dalil yig‘ishdagi imkoniyatlarini kengaytirish bo‘yicha ilmiy-amaliy takliflar ilgari surilgan.

This article analyzes the newly introduced institution of the investigating judge in the criminal procedural legislation of the Republic of Uzbekistan. The author conducts a comparative study of this institution with the French model (Juge d'instruction), which is considered its classical example. The paper highlights the characteristics, differences, and advantages of the "supervisor" model in Uzbekistan and the "active investigator" model in France. Furthermore, scientific and practical proposals are put forward to strengthen the protection of human rights in national legislation, optimize the procedural role of the prosecutor, and expand the opportunities for defense counsel to collect evidence.
